    I have just received an unsolicited letter from the above telling me I might have been mis-sold solar thermal.

    They are kindly offering to get me my money back ... so long as they can have 25% of it.

    What an unpleasant bunch off sponging toe-rags, they give solicitors a bad name.

    Has anyone else had one, and if so I would like to find out how they got my name and address?
    Apart from RHI I have never notified any one of and its not visible so they must be buying this information from someone.

    I would like to know who?

    Perhaps the company that installed it or one of those you asked to quote?

    There is a company advertising on some of the daytime TV channels under the banner "Claim more money". They want to speak to people that have already successfully claimed for something.

    Perhaps they might tell you if you ask them? Just an off chance if you phoned and asked nicely. Possibly a better chance if you discover exactly what rights you have to be told under data protection laws and quote the law at them? Maybe start by talking to Citizens Advice?

    Perhaps they don't know and are just fishing. Every so often I get a call from someone asking whether I want to claim for my accident. I've never been involved in a traffic accident or similar. Sometimes it's fun to play along and ask exactly which accident they mean ;-)

    Well the plot thickens.

    My solar was installed by a friend who is MCS qualified, and ironically he has had the letter as well.
    His is not registered with anyone so how do they get this information?

    I have spoken to the solicitors and they said they bought the information, I said I had never authorised my information to be used in this way and I would notify the Information Commissioner if I did not get to the bottom of it.

    As requested by them I have emailed them and they say they will advise me where they bought the information from.

    I will then presumably have to pursue them.

    I think the Information Commissioner is quite powerful and he certainly changed his tone when I mentioned them.

    There's probable a "no win no fee" outfit out there who could get to the bottom of this for you and make a claim on your behalf? :wink:

    I've just had a letter from the same organisation too. Knowing how my ST was purchased, fitted and, MCS registered I put the originators of the info leak with MCS.

    If the installation is the sort where the installer receives the RHI then they lodge something with the Land register so that is searchable. I guess also, the government are wiling to sell your private details as DVLA does to private clampers.

    I am pretty sure the only common source of this information is the MCS database.

    I don't know if they officially sell this information or it has been leaked but I will try and find out.

    Nigel,

    Not sure how much you know about the Data Protection Act but I'll assume just a little (apologies otherwise).

    Looks like the MCS scheme and database comes under DECC who have contracted Gemserv to manage it. That makes DECC the responsible organisation under the Data Protection Act

    However, your first point of contact would best be Gemserv and I suggest you tell them that you have been contacted by these solicitors and you are wondering how they got your information. If you phone first, I recommend following up with an email and make certain you get an acknowledgement.

    I guess the other possible source for your information would be Ofgem, who administer the RHI.

    Depending on the response from Gemserv, you will know your next course of action.

    By all means contact the Information Commissioner, who is duty bound to investigate. However, the Information Commissioner does not act on your behalf, an important point.

    The Data Protection Act does allow for individuals who have suffered from a breach of the Act to sue for damages, i.e. you will need to be able to demonstrate that you have suffered damage and that may not be easy to so do.

    I spoke to MCS administrators Gemserv yesterday and at their request sent them an email copy of the letter.

    I have not yet had a reply.

    I don't want damages, I am much more focussed on making sure that my data is protected and I don't like ambulance chasing solicitors either.

    I don't think this has come via RHI as a friend has had the letter and he registered his for MCS but has not done RHI.

    Nigel,

    I am following your case with great interest as I have a solar thermal system registered under RHI but have not received any similar letter to the one you got.
