    Hi, hope this is the right place for the discussion.

    I have a very specific question about the VAT reclaim for a new build.

    When we had concrete delivered, we were charged waiting time (because we took longer than the 10 minutes per cube allowed by the supplier).

    Can I reclaim the VAT on the waiting time?

    I know that if they had charged me a delivery fee and put it on the same invoice, we would be able to reclaim the VAT on the delivery fee. Similarly, tool/plant hire that comes with an operator (e.g. a crane or JCB) is eligible.

    Do you think that I could argue that wait time is hire of the concrete truck (with operator) and so is eligible for a VAT refund?

    but if you think that the wait time is hire of the truck then like all other hire charges such as plant and scaffolding it can not be claimed.

    Are you sure the concrete people should be charging you VAT at all - I think they are doing a supply and install - and if they are installing into a new build they should not charge VAT. If they should not charge vat you will not be able to claim back anything of it yourself. I'm not an expert here so don't take my word for it.

    You are right in that the hire of most things is ineligible but not everything. If what you hire comes with an operator, such as a crane, then you can get the supply zero rated (in which case I have missed the boat as the invoice is a couple of years old now and so can't be changed).

    The concrete is not a supply and install, it's just supply. Installation was by me. I'll just whack it in and try and reclaim the lot!

    Fortunately for me I have arranged most of this tricky hire/plant/bulk stuff to be invoiced by my builder with me seeking it out and specifying it - he can claim back the vat and zero rate the invoices to me. In the meantime I have given him a float to help his cash flow between paying the vat and claiming it back up to 3 months later. (only fair as he is not charging me a handling fee).

    Good that you've found such a helpful and trustworthy builder!

    I'd say that the waiting time counts as part of the delivery charge, so as long as it's on the same invoice it should be recoverable.
